Terms of Service
These Terms of Service (“Terms”) govern access to and use of the Conversatio.ai AI shopping assistant and related software, websites, and services (the “Service”) provided by Conversatio.ai (“Conversatio,” “we,” “us”). By installing, accessing, or using the Service, you agree to these Terms. If you are accepting on behalf of a business, you represent that you are authorized to bind that business.
The Service
Conversatio provides an AI assistant that merchants embed on their Shopify storefronts to help shoppers find products through natural-language conversation, and an admin interface for configuration and analytics. We may update, improve, or modify features over time.
Eligibility & accounts
The Service is for businesses and their customers. To install the app you must have a valid Shopify store and authority to install applications on it. You are responsible for maintaining the confidentiality of your store credentials and for activity that occurs under your account.
Merchant responsibilities
- Provide accurate catalog and configuration information.
- Maintain your own customer-facing privacy policy and obtain any consents required for the assistant to process shopper data on your storefront.
- Comply with applicable laws, the Shopify Partner Program and API terms, and these Terms.
- Be responsible for the content, pricing, availability, and fulfillment of products surfaced through the assistant.
Acceptable use
You agree not to: misuse or attempt to disrupt the Service; reverse engineer or circumvent security or rate limits; use the Service to violate the rights of others or applicable law; or use it to generate unlawful, infringing, or harmful content. We may suspend access to protect the Service or other users.
AI-generated output
The assistant’s responses and recommendations are generated by automated language models and may be inaccurate, incomplete, or not suitable for a given purpose. Recommendations do not constitute professional advice. Merchants are responsible for reviewing how the assistant represents their products, and shoppers should verify product details before purchasing.
Intellectual property
The Service, including its software, design, and content we provide, is owned by Conversatio and protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable right to use the Service while these Terms are in effect. You retain ownership of your store and catalog data; you grant us the rights needed to operate the Service as described in our Privacy Policy.
Third-party services
The Service runs on and integrates with third-party platforms, including Shopify and the infrastructure and AI providers described in our Privacy Policy. Your use of those platforms is also governed by their respective terms.
Data processing
Where we process personal data on a merchant’s behalf, that processing is governed by our Privacy Policy and, where required by applicable data-protection law, a Data Processing Addendum (DPA). Merchants who require a DPA may contact us at hello@conversatio.ai.
Disclaimers
The Service is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that the assistant’s output will be accurate.
Limitation of liability
To the maximum extent permitted by law, Conversatio will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, or data, arising out of or related to the Service. Our total liability for any claim relating to the Service will not exceed the amounts you paid us for the Service in the twelve months before the claim.
Termination
You may stop using the Service and uninstall the app at any time. We may suspend or terminate access if you breach these Terms or to comply with law or protect the Service. Provisions that by their nature should survive termination will survive.
Governing law
These Terms are governed by the laws of the State of California, USA, without regard to its conflict-of-laws rules. The exclusive venue for disputes will be the state or federal courts located in California, to the extent permitted by law.
Changes to these Terms
We may update these Terms from time to time. Material changes will be reflected by updating the “Last updated” date above and, where appropriate, by notifying merchants. Continued use of the Service after changes take effect constitutes acceptance.
